The Delhi High Court Rules In Students' Favour

As to the Delhi High Court ruling, a student is entitled to full marks if an examiner does not give marks against an answer but assigns a tick mark against it.

The bench of Justice C Hari Shankar ruled that the student should not suffer due to the examiner's error.

The court heard a plea filed by a class XII student who was not given marks for an answer in a Geography exam. The student argued that two tick marks were against her answer, indicating she was entitled to full marks. The CBSE (Central Board of Secondary Education) argued that the student was not entitled to full marks as no marks were given for the answer.

The court stated that once an examiner marks an answer as correct, the CBSE cannot appeal against the decision. The court also noted that a student will be given the benefit of the doubt when the examiner ticks the answer but fails to give marks. The student's plea was allowed.
